Terms and Conditions

These Terms and Conditions govern your access to and use of the Therapy Road website and your purchase of custom designed apparel and related products from Therapy Road. By placing an order or using this site, you agree to these terms in full. If you do not agree, do not use the site or place an order.

Therapy Road is operated by Therapy Road, with a business address at Los Angeles, Ca. References to “we,” “us,” and “Therapy Road” mean that entity. References to “you” mean the person or business placing an order or using the site.

1. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian to place an order. By placing an order, you represent that the information you provide is accurate and that you have the legal authority to enter into this agreement.

2. Products and Custom Orders

Therapy Road sells custom designed apparel and related goods. Products may be designed by Therapy Road, designed in collaboration with you, or printed using artwork that you supply.

All custom orders are produced specifically for you after your order is placed. Because each piece is made to order, custom items are final sale and not eligible for return, exchange, or refund except as described in Section 9.

2.1 Product Descriptions and Imagery

We make reasonable efforts to display product colors, fabrics, fits, and finishes accurately. Slight variations in color, print placement, fabric texture, and sizing are inherent to custom apparel production and are not considered defects. Screen calibration, lighting, and dye lots can affect how a finished product compares to digital previews and mockups.

2.2 Mockups and Proof Approval

Where mockups or digital proofs are provided, you are responsible for reviewing all elements, including spelling, layout, color, sizing, and placement, before approving production. Once you approve a proof, the order moves into production and cannot be modified or cancelled. Therapy Road is not responsible for errors in approved proofs.

2.3 Sizing

Size charts and fit notes are provided as a guide. You are responsible for selecting the correct size. Therapy Road is not liable for fit issues resulting from your size selection.

3. Customer Supplied Artwork and Content

If you provide artwork, logos, text, photographs, or other content for use on a custom order, you represent and warrant that:

You own the content or have all rights, licenses, and permissions necessary to reproduce, modify, and print it on apparel for commercial sale or personal use.
The content does not infringe any copyright, trademark, right of publicity, privacy right, or other intellectual property or proprietary right of any third party.
The content does not contain unlawful, defamatory, obscene, hateful, or otherwise prohibited material.

You agree to indemnify, defend, and hold harmless Therapy Road and its owners, employees, contractors, and affiliates from any claim, loss, damage, fine, or cost, including reasonable attorney fees, arising out of or related to content you supply, including any claim of infringement or misuse.

Therapy Road may decline to produce any order at its sole discretion, including orders involving content we believe may infringe third party rights or violate these terms. If we decline an order on these grounds, we will refund any amounts paid for the declined items.

4. Intellectual Property of Therapy Road

All designs, graphics, logos, photography, written content, and other materials created by Therapy Road and displayed on the site or on Therapy Road branded products are owned by Therapy Road or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Therapy Road materials without prior written permission.

Purchase of a Therapy Road branded product grants you ownership of the physical item only. It does not transfer any rights in the underlying design, artwork, or trademarks.

For collaborative or made to order custom designs, ownership and use rights will be set out in your order confirmation or separate agreement. Absent a written agreement to the contrary, Therapy Road retains rights to designs it creates and may use them in its portfolio, marketing, and future product offerings.

5. Orders, Pricing, and Payment

Prices are listed in U.S. dollars unless otherwise noted and may change without notice. The price applicable to your order is the price displayed at checkout.

Placing an order is an offer to purchase. Your order is accepted only when we send an order confirmation. We reserve the right to refuse, cancel, or limit any order, including orders that appear fraudulent, that contain pricing or product errors, or that exceed available inventory or production capacity.

Payment is due in full at the time of order unless we have agreed in writing to alternate terms. We accept the payment methods listed at checkout. By providing payment information, you authorize us to charge the applicable amount, including taxes and shipping. You represent that you are authorized to use the payment method provided.

If your payment is reversed, charged back, or otherwise disputed without grounds permitted under these terms, you remain responsible for the full amount owed plus any associated fees.

6. Production Timelines

Estimated production times are listed at checkout or on individual product pages and begin only after final proof approval and payment clearance. Production times are estimates, not guarantees. Therapy Road is not liable for delays caused by suppliers, carriers, weather, labor disruptions, equipment failures, or other circumstances outside our reasonable control.

If a delay is expected to exceed our estimated timeline by a material amount, we will notify you and provide an updated timeline.

7. Shipping and Delivery

Shipping costs and methods are calculated at checkout based on your destination and selected service. Risk of loss and title pass to you upon delivery to the carrier.

Delivery times provided by carriers are estimates. Therapy Road is not responsible for carrier delays, lost packages once in carrier custody, or incorrect delivery resulting from address errors you provided.

For international orders, you are the importer of record and are responsible for all duties, taxes, customs fees, and compliance with local import laws. Refused or undeliverable international packages are not eligible for refund of shipping costs.

8. Cancellations and Changes

Orders may be cancelled or modified only before production begins. Once production has started, the order cannot be cancelled, modified, or refunded. We will confirm in writing whether your cancellation or change request was received in time.

9. Defects, Returns, and Refunds

Custom orders are final sale. Returns, exchanges, and refunds are not available based on personal preference, fit, or buyer’s remorse.

If your order arrives with a manufacturing defect or differs materially from your approved proof, contact us at support@shoptherapyroad.com within seven (7) days of delivery with your order number and clear photographs. We may, at our discretion, repair the item, reproduce the item, or issue a refund or store credit for the defective item.

Issues that are not considered defects include but are not limited to: minor variations in color, print placement, or sizing within industry standard tolerances; loose threads or trim variances; fading or shrinkage from improper care; and dissatisfaction with elements you approved on a proof.

Care instructions are provided with each order. Damage caused by improper laundering, ironing, or use is not covered.

10. Acceptable Use

You agree not to use the site or our services to:

Submit content that is unlawful, infringing, defamatory, harassing, or hateful.
Impersonate another person or misrepresent your affiliation with any person or entity.
Interfere with the operation of the site, attempt to access non public areas, or probe for vulnerabilities.
se automated tools to scrape, copy, or harvest content from the site.
Resell or commercially exploit Therapy Road branded designs without prior written authorization.

11. Disclaimers

The site and all products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Therapy Road disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non infringement, and warranties arising from course of dealing or trade usage.

We do not warrant that the site will be uninterrupted or error free, that defects will be corrected, or that the site is free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Therapy Road and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the site or any product purchased from us, even if advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or related to these terms or any product or service will not exceed the amount you paid to Therapy Road for the specific product or service giving rise to the claim during the six (6) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Therapy Road and its owners, employees, contractors, and affiliates from any claim, loss, damage, liability, cost, or expense, including reasonable attorney fees, arising out of or related to: your use of the site; your breach of these terms; content you submit, supply, or approve for production; and your violation of any law or third party right.

14. Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or related to these terms or your use of the site or our products is subject to the dispute resolution provisions in Section 15.

15. Dispute Resolution and Arbitration

Before filing any claim, the parties agree to attempt in good faith to resolve the dispute by direct communication for at least thirty (30) days after written notice.

If the dispute is not resolved, any claim, controversy, or dispute arising out of or related to these terms, the site, or our products will be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER, e.g. JAMS or AAA] under its consumer arbitration rules. The arbitration will be conducted in California or by video conference. Each party will bear its own attorney fees and costs unless the arbitrator awards them otherwise.

You and Therapy Road agree that any dispute will be brought only in your or our individual capacity and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate claims and may not preside over any class proceeding.

Not with standing the above, either party may bring an individual claim in small claims court if the claim qualifies, and either party may seek injunctive or equitable relief in court to protect intellectual property rights.

16. Force Majeure

Therapy Road is not liable for any failure or delay in performance caused by circumstances outside our reasonable control, including acts of God, natural disasters, pandemics, government actions, labor disputes, supplier failures, carrier delays, or interruptions of utilities or telecommunications.

17. Changes to These Terms

We may update these terms at any time by posting a revised version with a new effective date. Your continued use of the site or placement of new orders after the effective date constitutes acceptance of the revised terms. The version in effect at the time you placed your order governs that order.

18. Severability and Entire Agreement

If any provision of these terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. Failure to enforce any provision is not a waiver of that provision.

These terms, together with any order confirmation, proof approval, or written agreement signed by Therapy Road, constitute the entire agreement between you and Therapy Road regarding your use of the site and any products purchased from us, and supersede any prior or contemporaneous communications.
